Terms and Conditions

Below I set out the main terms and conditions under which I offer each of the properties on my website for your holiday rental in Vejer de la Frontera. This is a generic document that covers the terms for all the properties.

The agreement is set out to clarify my obligations to you, your obligations to me, and in the very unlikely event of any disputes, I will use this document as a basis for any resolution.

Please read it carefully before confirming your booking and ensure that it conforms to your understanding of what you expect from the holiday rental.

 

Essential Definitions

"Rental Period"

The period begins at 16:00 on the agreed start date of the booking and ends at 10.00 on the agreed final date.

"I"

Linda Cooper of 138 Percheron Drive, Knaphill GU21 2QZ, trading as “Casacooper” and acting as the Owner’s representative.

"You"

The person named on the booking form who will take singular responsibility for the entire party for the entire Rental Period.

"The Property"

The property being rented will be defined on the booking form.

“Owner”

The owner of the property who is using Casacooper as letting agent to administer the rental on his or her behalf.

What We offer

  1. At any time prior to the commencement of the rental, I will respond to any queries You may have in a timely and professional manner.
  2. Once a reservation has been accepted by me, I will set out clearly and in writing the timetable of payments, the amounts and the dates by which they should be received.
  3. Normal arrival time is 16.00 on the start date of the rental period and end time is 10.00 on the departure date.
  4. I will provide a clean, well maintained holiday property suitable for the number of people listed on the booking form.
  5. The property is cleaned before your arrival and after your departure.

Payment terms:

You will pay me the agreed rental fee as follows:

·         20% of the basic rental charge with a minimum payment of £175 or €200 is payable as a deposit upon booking. The booking cannot be considered accepted until this is received by me.

·         6 weeks before the start date of the Rental Period, You will pay me the balance. In addition You will pay a security deposit as detailed in “Security Deposit”. This deposit will be banked by me and held in accordance with the terms set out in paragraphs 15 to 18 below.

·         Delay in any payment will constitute cancellation by You of the booking.

General notes:

1.     You will allow maintenance personnel, cleaning staff, the Owners and the Owner’s representative reasonable access to the property for the purposes of repair and maintenance.

  1. You will not smoke inside the Property, and You will ensure that no one else in your party does either.
  2. If you lock yourself out of the property and it is necessary to call out a locksmith the charge will be passed on to You.  Please do not leave keys in the back of the front door.

4.     I  and/or the Owner shall not be liable to You for:

a)     Any temporary defect or stoppage in the supply of public services to “The Property”, nor in respect of any equipment or appliances in “the Property”.

b)     For any loss, damage or personal injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond our control.

c)     For any loss, damage or inconvenience caused to our suffered by You if the Property shall be destroyed or substantially damaged before the start of the rental period.  In any such event I will wherever possible transfer you to a similar alternative property or if this is not possible a full refund will be given.

d)     Any loss or inconvenience due to noise or disturbance from anywhere within the vicinity of the property.

5.     Under no circumstances shall the owners’ liability to You exceed the amount paid to the owners for the rental period.

  1. The property is to be occupied only by the party named on the booking form.
  2. You and your party agree not to act in any way which would cause disturbance to those resident in neighbouring properties. If in the option of the Owner or me any of the party are guilty of conduct prejudicial to the property or are in breach of the law, or cause a serious disturbance, the Owner or their agent may take re-possession of the property without notice or refund to the client.
  3. All vehicles are parked outside the property at the your own risk.
  4. Neither I nor the Owner can accept any responsibility for changes to the opening times or days of the communal swimming pool.

SECURITY DEPOSIT

1.       When You pay the final instalment, You will also pay me a security deposit of £100 or  120 for bookings of 3 weeks or less and £200 or €240 for bookings of over 3 weeks. I will bank this and hold against any undue damage or serious loss or breakage incurred during your stay.

2.       If there are no problems, then I will refund 100% of this deposit to You within 7 days of the end of the Rental Period.

3.       Should I need to retain any of these funds, I will notify You in advance of returning the balance.

4.       The sum reserved by this clause shall not limit your liability to me or the owner in the event of major damage.

CANCELLATION

1.       For cancellations received more than six weeks before the commencement of the Rental Period the deposit will be forfeited in full.

2.       For cancellations received less than six weeks before the commencement of the Rental Period all monies (except the security deposit) will normally be forfeited.
However, I will make efforts to re-let the Rental Period and any monies received by me for rentals for this period will be used to make repayment to You. Repayments may be reduced by any out of pocket expenses incurred by me in finding alternative guests, and will include any additional advertising costs, any late booking discount and any reduction in rentals paid for a shorter booking during this period.

3.       If for any reason the booking is cancelled by me, all money paid by You to me including the deposit will be refunded to You immediately.

4.       All cancellations must be made in writing.

YOU ARE STRONGLY RECOMMENDED TO ARRANGE COMPREHENSIVE TRAVEL INSURANCE INCLUDING CANCELLATION COVER, FULL COVER FOR THE PARTY’S PERSONAL BELONGINGS AND PUBLIC LIABILITY SINCE THESE ARE NOT COVERED BY THE OWNER’S INSURANCE
